Terms & Conditions

1. Scope

These Terms govern the contract between Kistler Toys International, Waidlistrasse 88, 8810 Horgen (hereinafter "Party Plushies") and the customer for all orders placed via partyplushies.ch. Deviating terms of the customer do not apply unless expressly accepted by us in writing.

2. Conclusion of contract

The presentation of products in our online shop does not constitute a legally binding offer but an invitation to order. By submitting an order you make a binding purchase offer. The contract is concluded upon our order confirmation by email.

3. Prices

All prices are quoted in Swiss Francs (CHF), including statutory VAT where applicable. The prices displayed in the shop at the time of order are decisive.

4. Payment methods

Charges are made when the order is placed. Payment data is processed directly and encrypted by the respective payment provider.

5. Delivery & shipping

We ship within Switzerland. Delivery typically takes 2–4 working days after receipt of payment.

Shipping is free from one ordered product onwards. Products in the "Accessories" category are excluded — for accessories-only orders, shipping fees may apply and will be shown transparently before checkout.

Delivery times are non-binding guidance. Delays beyond our control (e.g. force majeure, carrier strikes) do not entitle the customer to cancel.

6. Retention of title

The goods delivered remain our property until full payment has been received.

7. Right of return

You may return goods within 14 days of receipt provided they are unused and in their original packaging. The customer bears the return shipping costs unless the item is defective. After receipt and inspection, we refund the purchase price via the original payment method.

Note: Swiss law does not provide a general statutory right of withdrawal for online orders. The return right above is granted voluntarily as a goodwill gesture.

8. Warranty

Statutory warranty provisions under Swiss law apply. Defects must be reported in writing without delay after receipt of the goods to info@partyplushies.com.

9. Liability

We are liable without limitation for intent and gross negligence. Liability for slight negligence is excluded to the extent permitted by law. Liability for consequential damages, lost profits or indirect damages is excluded.

11. Applicable law & jurisdiction

Swiss law applies exclusively, under exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is — to the extent permitted by law — Horgen, Switzerland.
